The fine print, in plain words

Terms

These terms explain how a booking with us works and how this website may be used. When you book, your signed agreement is the contract, and it controls if anything here reads differently. Read how we handle your information in our privacy policy.

Updated October 19, 2026

01Who we are

Elena Kay Photography, LLC is a Delaware limited liability company. It is the only company you contract with when you book us, and every payment goes to it. Our principal place of business is 74 Fairview Avenue, Holtsville NY 11742. Call (631) 213 5013 or write info@elenakayphotography.com.

02Prices, quotes, and offers

Prices on this website are our published prices. They invite you to ask about your date. They do not hold a date. A price, offer, or perk becomes part of your booking only when it is written into a quote you accept or into your signed agreement. We may correct an obvious error in a price or in wording before that point.

Published prices do not include sales tax. Every discount and free upgrade we advertise follows our written offer rules.

03Booking and payment

Your date is reserved when you sign the agreement and pay the reservation fee. Most bookings pay 50% to reserve the date and 50% one day before the event. Your written payment schedule shows your exact amounts and dates.

We accept cash and credit or debit cards through Stripe. We do not accept checks. A late payment carries a $200 fee. Final photos, films, and clips are released once everything due has been paid.

If you have a billing problem, tell us in writing and give us 14 days to fix it before you file a chargeback or payment dispute.

04Cancelling or moving your date

Ask to reschedule at least 90 days before the event. The new date has to be open, and your payments move to it.

The reservation fee holds your date, and we turn away other couples once it is paid, so it is nonrefundable if you cancel. Payments beyond the reservation fee are handled this way:

  • Cancelled more than 180 days before the event: refunded in full.
  • Cancelled 90 to 180 days before the event: 50% refunded.
  • Cancelled fewer than 90 days before the event: not refunded.
  • If we book another paid wedding for your date, we refund payments beyond the reservation fee, minus costs we already spent on your event.
  • If something outside everyone's control, like a natural disaster, a government order, or a pandemic restriction, stops the wedding, your payments become a credit toward a new date within 18 months. If we have no date you accept in that window, we refund your payments minus documented costs already spent on your event.

05Free and complimentary items

Anything we call free, complimentary, a bonus, or included at no charge is named in your booking package, and every condition on it is stated there. Complimentary items:

  • come only with a fully paid package, and we never raise the package price to cover them
  • have no cash value and cannot be traded for cash, refunds, credits, or other services
  • stay with the couple and event named in the agreement
  • are forfeited if the booking is cancelled, the agreement is breached, or a payment is past due
  • must be scheduled or claimed within 12 months after the event, and scheduling is up to you
  • may be swapped for an item of equal or greater value if the original becomes unavailable
  • are delivered digitally, like everything else

06Delivery and your files

Teaser photos arrive within 1 week and the full edited gallery within 3 months. With film, the highlight film arrives within 1 week and the full edited film within 6 months. Raw video files are released by download after both films are delivered. Content creator clips arrive by download link within the window in your package.

If something unforeseen moves a delivery date, we tell you in writing with a new date no more than 60 days after the original one. Rush delivery is $999 for photos in 10 days and video in 30 days. Additional edits after delivery are $500 for photos and $800 for video.

Files stay online for 2 years from each delivery. Download and back up everything before then. After that, files may be deleted. If our archive still has them, we can retrieve them for $500, with no guarantee they still exist.

Everything is delivered digitally by download link. We never deliver on USB drives, hard drives, discs, or memory cards. We do not sell prints or albums. When you want them, we point you to independent print and album companies, and we may earn a referral commission when you order through our link.

07Content creator

Our content creator films vertical video and photos on a phone only. No professional cameras, external microphones, lights, gimbals, or drones are used.

Every clip is delivered raw, exactly as captured. We do not trim, select, color, or stabilize clips, and we do not add music, captions, text, or transitions. We do not make finished reels or ready to post videos. Phones struggle in low light, at a distance, and in loud rooms, so image quality and audio, including vows and toasts, are not guaranteed.

The couple plans any trending videos, dances, or challenges. Send us your list with reference links before the wedding and gather the people at the time you choose. We film what you set up. We never log in to your accounts or ask for passwords, and the music you add inside each app has to follow that app's rules.

08What we need on the wedding day

Good coverage depends on time and access. These are part of every agreement:

  • Time for photos: 1 to 2 hours for the bride getting ready, 1 hour for the groom when he gets ready separately, and 1 hour and 30 minutes for portraits, the wedding party, and family, on top of the ceremony, travel, and reception.
  • A written family and must have photo list before the wedding, and one family member or planner who gathers people at the scheduled time.
  • Reserved or paid parking for each of our vehicles within one city block of each entrance where available, plus a secure place to store gear we can reach all day, confirmed in writing 14 days before the wedding. Without it, parking, garage, and toll costs are added to your final balance, and time spent hauling gear counts against your coverage.
  • Every permit and location fee for the places you choose, including parks, beaches, houses of worship, and private property, paid by you.
  • A meal for each team member when coverage runs over 4 hours.
  • Our certificate of insurance, naming your venue or photo location as an additional insured, is available on written request at least 14 days before the wedding. We provide our own certificate only.
  • Respect for the team. Threats, lewd behavior, or heavy intoxication aimed at our team can end coverage without a refund.

09Weather, light, and live moments

A wedding is a live event that happens once. We will not pause, restage, or move the ceremony or any moment for better light or a better angle. You and your venue choose the locations, the direction the ceremony faces, and the start times. If a late start puts the setting sun behind you, the glare, flare, and squinting are part of the day.

Weather and rain plans belong to you and your venue. We suggest alternatives, like moving inside when it is cold, but a suggestion is not a guarantee, and if it is declined we are not responsible for the result. We stop outdoor work when conditions are unsafe, including lightning.

We work to keep distractions out of frame, but we cannot promise a frame free of trash cans, bus tubs, exit signs, sconces, DJ lights, trees, or guests holding phones. Everyone present appears in the coverage, and we do not search for, blur, or remove people from the files.

We are not responsible for photos missed because someone was late, absent, nursing a child, smoking, or not on your list, for audio lost to the DJ, band, venue speakers, wind, or crowd noise, or for dirt or damage to attire at locations you chose. You can decline any pose or location.

Final selection and editing happen after the wedding, so no one can say what was captured until your gallery arrives. We discuss the agreement and your files only with the couple named in it, and we review concerns once the full gallery is delivered.

10Gratuity

Like other wedding vendors, our photographers, videographers, and content creators customarily receive a tip. The suggested gratuity is 10 to 15% of your contract total. It is voluntary, it is not part of the contract price, and it never changes your service or delivery. Every dollar goes in full to the team members who worked your day.

12Limits on our liability

If something goes wrong on our side, including equipment failure or lost files, our total liability is limited to what you paid us under your agreement. We are not liable for indirect, special, punitive, or emotional distress damages. These limits do not apply to gross negligence or willful misconduct.

Tell us in writing about any problem with a delivery within 90 days of receiving it, so we have a chance to fix it. That notice does not shorten any time the law gives you to bring a claim.

13Disputes

New York law governs our agreements and this website. A lawsuit goes to the state courts in Suffolk County, New York, and either side may use small claims court when the amount qualifies. In a case to enforce an agreement, the side that wins may recover reasonable attorneys' fees and costs.

14Using this website

The photos, films, and writing on this website belong to us. You may view them here, but you may not copy, download for reuse, publish, or sell them without our written permission.

Pages on this website are general information. Links to other websites are for convenience, and we do not control those sites. We work to keep this website accurate and online, but we cannot promise it is free of errors or always available.

Please use our forms only to ask about a real date or session. We filter spam and may ignore or block automated or abusive messages.

15Changes to these terms

We may update this page. The date at the top shows the current version. An update applies to bookings made after it is posted and never changes an agreement you already signed. If this page and your signed agreement ever differ, your signed agreement controls.

A full, current copy of your signed agreement is available for download upon request through your client portal or by writing to us.
